Appointment of Chief Minister

The CM of India is chosen by the Governor. But the Governor is not free or self-governing in the appointment of CM. He can choose only the leader of the majority party in Legislative Assembly as the Chief Minister of state. If the administrator selects somebody else to this post then the management of the state cannot be run smoothly. If no party commands complete majority in the Legislative Assembly of the state or the majority party fails to choose its leader, the Governor can use some judgment in appointing the CM. But he is to see that the Chief Minister can get the support of the majority in the legislature.

Tenure of Chief Minister

Tenure of the CM of India is maximum for five years. The Chief Minister remains in place of work so far he is sustained by the majority of the members of the Legislative Assembly. The CM gives notice(resigns) when the majority in Legislative Assembly goes against him.

Formation of the Ministry

Chief Minister forms the Cabinet. After his engagement he prepares a list of other Ministries and the administrator makes appointments of ministers according to that list. No person can be chosen minister against without the will of CM.

Departments are disseminated among the ministers by CM. The Chief Minister looks after the work of other ministers. He can change the division of Ministers at any time he likes. The ministers keep CM informed about the working of their departments. They get information of CM whenever necessary.

Removal of Ministers

The ministers remain in place of work all through the pleasure of Chief Minister. The administrator cannot eliminate ask any minister to give notice if he is not happy with his work. He can make an accusation in his Council of Ministries whenever he likes.

Chairman of the cabinet

The director cannot take part in the conference of cabinet. The CM calls the conference of the Cabinet and presides over its meeting. He also organized and controls the agenda for cabinet assembly. The Cabinet takes its judgment unanimously and normally the views of the Chief Minister carry weight.

Leadership in the cabinet in the Legislative

CM can attend the conference of both the Houses and can take part in their working. The members of administration ask questions to cabinet members and criticize their policies and actions. When a minister cannot give agreeable reply to criticism of a member, Chief Minister assists the minister in fulfilling the member. The significant resolution taken by Cabinet is publicized in the Legislative by CM.
